User Agreement
This agreement is entered into between you and Wuxi Lingbo Electronic Technology Co., Ltd. and its affiliated companies (hereinafter referred to as "Lingbo Electronics" or "we") regarding your downloading, installing, using this software, and using related services.
2.1 To use this software, you must carefully read (if you are under 18 years old, you should read it with a guardian), fully understand and accept all the terms of this User Agreement (hereinafter referred to as "this Agreement"), especially the clauses that exempt or limit Lingbo Electronics' liability, restrictions on user rights, dispute resolution methods, and provisions on jurisdiction and applicable laws.
2.2 Unless you have carefully read, understood, and accepted this Agreement, you have neither the right nor the need to continue using this software and related services. You may choose to withdraw from this registration. If you complete this registration and continue to use this software and related services, it is deemed that you have carefully read, understood, and agreed to be bound by this Agreement. If you do not agree to this Agreement, please uninstall this Software after installation.
2.3 This Agreement takes effect from the date you begin using this software or related services and register as a Lingbo Electronics user. Please carefully consider whether to accept this Agreement. If you do not accept any terms of this Agreement, please automatically withdraw and no longer accept any services from Lingbo Electronics.
2.4 After you sign this agreement, the text of this agreement may be modified due to changes in national policies, products, or the environment in which this agreement is implemented. We will publish the revised agreement on this software and notify you through prominent reminders, SMS, and other means. If you have any objections to the revised agreement, please immediately stop logging in or using Lingbo electronic products and services; If you log in or continue to use Lingbo electronic products, it is deemed that you have accepted the modified agreement and agreed to be bound by the above content.
2.5 If you are a minor under 18 years old, you must obtain written consent from your parents or legal guardians in advance before using the services of this software, and comply with relevant laws, regulations, and policies regarding vehicle driving and road safety.
3.1 This software provides a user registration channel. After accepting and agreeing to this agreement, users have the right to choose unused alphanumeric combinations or email addresses as their accounts and to set passwords that meet security requirements. The account and password set by users serve as credentials for logging in to this software and accepting services.
3.2 Registering an account in this software does not mean that users are authorized to use all products of Lingbo Electronics; it only means they have obtained the status to receive the services of this software. When users log in to relevant web pages, load applications, or download and install software, they need to sign a separate product authorization agreement.
3.3 The ownership of this software account belongs to Lingbo Electronics. After completing registration, users only obtain the right to use the account, which belongs solely to the initial applicant. Gifting, borrowing, renting, transferring, or selling it is prohibited. If it is discovered or suspected that the user is not the original registrant of the account, Lingbo Electronics has the right, without notice, to suspend or terminate services provided to the user and has the right to cancel the account without bearing any legal responsibility to the user of the account. Any resulting losses, including but not limited to communication interruption or deletion of user data and information, shall be borne by the user. The account cannot be inherited.
3.4 Users are responsible for maintaining the security and confidentiality of their personal accounts and passwords. Users are fully responsible for all activities occurring under their account and password (including modifying user information, posting comments, and any other losses), and users should pay attention to protecting their accounts and passwords. If users discover that others have used their accounts without permission or encountered any other security vulnerabilities, they should immediately contact the relevant staff of this software. Lingbo Electronics assumes no responsibility for any loss or damage incurred by users due to violations of the above rules during the use of this software.
3.5 If a user loses their account or forgets their password, they can retrieve it using the unique mobile phone number bound during registration. If the user automatically waives the bound phone number during registration, this software will consider the user to automatically waive the right to recover their password and account, and Lingbo Electronics shall not bear any resulting consequences.
3.6 Users shall ensure the authenticity of the identity information provided when registering this software account. All responsibilities arising from providing illegal, false, or inaccurate user information shall be borne by the user. Users shall update registration information promptly according to actual circumstances, meeting the requirements of timeliness, completeness, and authenticity. All originally entered information will reference the user's account registration information. Lingbo Electronics shall not bear any responsibility for any consequences arising from inaccurate or untrue registration information provided by the user. If a user provides illegal, untrue, or incomplete information, or if Lingbo Electronics reasonably suspects such information is illegal, untrue, incomplete, or publishes advertisements, non-serious content, or irrelevant information in personal profiles, this software has the right to suspend or terminate services provided to the user, cancel the account, and refuse users to use all or part of the software services in any form. All losses arising therefrom shall be borne by the user.
4.1 You may create a copy of this software solely for the purpose of using the software and its services, and the backup copy must include all copyright information contained in the original software.
4.2 All other rights not expressly granted to you in this agreement, including but not limited to any additional rights, shall be reserved by us, and you may exercise these rights with our written permission. Our failure to exercise any of the above rights does not constitute a waiver of such rights.
5.1 You may obtain this software from our official website or from authorized third parties.
5.2 If you obtain this software from an unauthorized third party or an installer with the same name as this software, we cannot guarantee that the software will be used normally and are not responsible for any losses caused to you as a result.
6.1 We may develop different software versions for different terminal devices. You should choose the appropriate version for installation based on your actual situation. This software may provide multiple application versions including but not limited to iOS, Android, etc. You should select the software version that matches the device you are installing.
6.2 After downloading the installer, you need to follow the steps prompted by the program to install it correctly.
6.3 If you no longer need to use this software or need to install a new version, you may uninstall it yourself.
7.1 To improve user experience and enhance service content, we will continuously develop new services and provide software updates from time to time (these updates may take the form of software replacement, modification, feature enhancement, version upgrades, etc.).
7.2 To ensure the security and consistency of this software and services, we reserve the right to update the software without special notice or to change or restrict certain functions and effects of the software.
7.3 After the new version of the software is released, the old version may become unusable. We do not guarantee that the old version of the software will remain usable, nor do we guarantee corresponding customer service. Please check and download the latest version at any time.
8.1 You understand and agree that, in order to provide you with effective services, this software will utilize the processor and bandwidth resources of your terminal device. Data traffic fees may be incurred during the use of this software. Users should obtain relevant tariff information from the operator and bear the related costs themselves.
8.2 When you use specific services of this software, those services may have separate agreements and related business rules (hereinafter collectively referred to as "separate agreements"). Please read and agree to the relevant separate agreements before using the service. By using the above specific services, you are deemed to have accepted the relevant separate agreement.
8.3 You understand and agree that we will make commercially reasonable efforts to ensure the security of your data storage in this software and services, but cannot provide full protection, including but not limited to the following:
8.3.1 We are not responsible for your failure to delete or store related data in this software and services;
8.3.2 We have the right to determine the maximum storage period for individual users in this software and services based on actual circumstances and to allocate the maximum storage space on the server. You may back up your relevant data in this software and services as needed;
8.3.3 If you stop using this software and services, or if the service is terminated or cancelled, we may permanently delete your data from the server. After the service is terminated, terminated, or canceled, we have no obligation to return any data to you.
8.4 When using this software and services, users must bear the following uncontrollable risks, including but not limited to:
8.4.1 Risks such as loss or leakage of personal information that may arise due to uncontrollable factors;
8.4.2 Users must select software versions that match the installed terminal devices; otherwise, any problems or damages caused by mismatches between the software and terminal device models shall be borne by the user;
8.4.3 Users bear all risks arising from accessing third-party websites and related content while using this software;
8.4.4 Any risks and legal responsibilities arising from others sharing or reprinting user-published content shall be borne by the user;
8.4.5 Risks caused by unstable network signals, limited network bandwidth, and other factors, including login failures, incomplete data synchronization, slow page loading speeds, etc.;
8.4.6 During the use of this software, there may be anonymous or impersonated information received, which may be threatening, defamatory, attacking, illegal, or infringing on others' rights (including intellectual property rights). Users bear all risks. The software makes no warranties, express or implied, including but not limited to guarantees of authenticity, suitability, fitness for a particular purpose, ownership, and non-infringement. The software assumes no responsibility for direct, indirect, incidental, special, or consequential damages caused by improper or illegal use of the service by users;
8.4.7 For overall operational needs, we have the right to modify, interrupt, suspend, or terminate the service without prior notice to users or third parties, without any liability for compensation;
8.4.8 Internet technology itself is unstable and may face risks such as government control, policy restrictions, virus attacks, hacker attacks, server system crashes, or other issues that current technology cannot resolve. Users shall bear all losses caused by non-human factors such as service interruptions or loss of account information.
You understand and agree that we are committed to providing users with a civilized, healthy, and orderly online environment. You are responsible for all actions under your registered account (including any content you post and its consequences). You should judge your own actions by accessing content on this service and bear all risks associated with using such content, including reliance on its accuracy, completeness, or usefulness. We cannot and will not be liable for any loss or damage arising from the above risks.
Users must comply with relevant laws and regulations when using this software, including but not limited to the Constitution of the People's Republic of China, the Criminal Law of the People's Republic of China, the Civil Code of the People's Republic of China, the Copyright Law of the People's Republic of China, the Telecommunications Regulations of the People's Republic of China, the Measures for the Administration of Internet Information Services, the Regulations on the Administration of Internet Electronic Bulletin Services, and the Interim Provisions on the Administration of International Computer Information Networks. Users bear full responsibility for the legal liabilities (including but not limited to speech and transmitted content) arising from illegal or improper use of this software. Users must not use this software to engage in any illegal or infringing legal rights and interests of individuals, companies, social groups, or organizations, or any acts restricted or prohibited by laws, rules, or other legal normative documents. Under any circumstances if we reasonably believe that any user (including but not limited to speech and other behavior) violates or may violate laws, regulations, national policies, or any terms of this agreement, we reserve the right to terminate services provided to the user without prior notice.
9.1 Information Content Standardization
Users must not use this software to engage in activities that violate laws and regulations, interfere with the software's policies, or infringe upon the legitimate rights and interests of others, including but not limited to the following behaviors:
9.1.1 Publishing, transmitting, disseminating, or storing content that violates national laws and regulations, including: (1) violating the basic principles established by the Constitution; (2) endangering national security, leaking state secrets, subverting state power, or undermining national unity; (3) damaging national honor and interests; (4) inciting ethnic hatred or discrimination, undermining ethnic unity; (5) undermining national religious policies, promoting cults and feudal superstitions; (6) spreading rumors, disrupting social order, or undermining social stability; (7) spreading obscenity, pornography, gambling, violence, terrorism, or inciting crime; (8) insulting or defaming others, infringing upon their lawful rights and interests; (9) Inciting illegal assemblies, associations, marches, demonstrations, or gathering crowds to disrupt social order; (10) Operating under the guise of illegal civil organizations; (11) Containing other content prohibited by laws, administrative regulations, or normative documents with legal effect;
9.1.2 Publishing, transmitting, disseminating, or storing content that infringes upon others' reputation, portrait rights, intellectual property rights, trade secrets, or other lawful rights;
9.1.3 Publishing, transmitting, or disseminating content involving others' privacy, personal information, or materials;
9.1.4 Posting, transmitting, or disseminating harassing information, advertising information, excessive marketing information, and any content containing sexual or sexual suggestions;
9.1.5 Publishing, transmitting, or disseminating other information content that violates laws, regulations, policies, public order and good customs, social ethics, or interferes with the normal operation of this software, infringing upon the legitimate rights and interests of other users or third parties;
9.1.6 Using this software to publish, transmit, disseminate, or store content that infringes upon others' intellectual property rights, trade secrets, portrait rights, privacy rights, or other legitimate rights and interests, or is morally objectionable;
9.1.7 Engaging in publishing advertisements, promotional information, selling goods, or any illegal activities that harm the interests of Lingbo Electronics.
9.2 Software Usage Guidelines
9.2.1 It is prohibited to use this software for any acts that endanger computer network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; accessing public computer networks or others' computer systems without permission to delete, modify, or add stored information; attempting to probe, scan, or test weaknesses in the software system or network or other acts that undermine network security without permission; attempting to interfere with or disrupt the normal operation of this software, intentionally spreading malicious programs or viruses, or other acts that disrupt normal network information services; forging TCP/IP packet names or part of their names; or using this software or other software to reverse crack products provided by China NetCai, among other illegal acts.
9.2.2 Except as permitted by law or with our written permission, you may not engage in the following activities during your use of this software: (1) Delete copyright information from this software and its copies; (2) Reverse engineer, discompile, or otherwise attempt to discover the source code of this software; (3) Use the content we own in this software by using, renting, lending, copying, modifying, linking, reposting, compiling, publishing, or creating mirror sites; (4) Using any form of copying, modifying, adding, removing, or creating derivative works, including but not limited to accessing this software and related systems using plugins, plugins, or third-party tools/services not authorized by us; (5) Modifying or forging instructions or data during software operation, adding, deleting, or changing software functions or operational effects, or operating or publicly disseminating software or methods used for such purposes, whether for commercial purposes or not; (6) Logging in to or using this software and services through third-party software, plugins, plugins, or systems not developed or authorized by us, or creating, publishing, or distributing such tools; (7) Engaging in interference with this software and its components, modules, or data by yourself or authorizing others or third-party software; (8) Other acts not explicitly authorized by us.
9.3 Service Operation Standards
Unless permitted by law or with our written permission, you may not engage in the following acts during your use of this service: (1) Submitting or publishing false information, or impersonating or using another person's name to use, rent, lend, copy, modify, link, repost, compile, publish, or establish mirror sites to manipulate content in this software that we hold intellectual property rights for; (2) Inducing other users to click linked pages or share information; (3) Fabricating facts or concealing the truth to mislead or deceive others; (4) Infringing upon others' reputation, portrait rights, intellectual property, trade secrets, or other lawful rights and interests; (5) Using this software, account, or service to engage in any illegal or criminal activities; (6) Creating, publishing, or disseminating methods or tools related to the above behaviors, or operating or disseminating such methods or tools, whether for commercial purposes or not; (7) Other acts that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of the product, or act without our explicit authorization.
10.1 Lingbo Electronics owns the intellectual property rights of this software and its related products and services. (1) All intellectual property related to this software, including but not limited to copyrights, trademark rights, patent rights, trade secrets, and all information related to this software (including but not limited to software, programs, works, text, images, audio, video, charts, web pages, interface design, layout framework, related data or electronic documents, etc.), is protected by the laws and regulations of the People's Republic of China and relevant international treaties. The company owns the above intellectual property rights, except for rights that should be enjoyed by relevant rights holders according to law. (2) Without the written consent of the company or relevant rights holders, you may not implement, utilize, or transfer the above intellectual property rights to any third party for any commercial or non-commercial purpose.
10.2 Users may only use the intellectual property rights of this software within the scope authorized by this agreement and the corresponding licensing agreements. Unauthorized use beyond the authorized scope constitutes infringement against Lingbo Electronics.
10.3 When users publish or upload text, images, or other information while using this software, they constitute authorization to the Software Service Platform. This license is non-exclusive, permanent, and may be sublicensed. This software may use the above information on all service platforms under Lingbo Electronics, and may be edited and used again. It may also be authorized by Lingbo Electronics to be used by partners.
10.4 If users infringe on third-party intellectual property rights or violate the user behavior norms stipulated in this agreement by publishing, transmitting, distributing, distributing, or storing text, images, videos, or other information through the use of this software service, Lingbo Electronics has the right to delete or block infringing products without notice and bears no responsibility. Lingbo Electronics may penalize violating accounts according to the severity, including but not limited to warnings, restricting or prohibiting the use of some or all functions, account bans or cancellations, and announcing the handling results. Users shall handle the above third-party rights claims themselves and bear all related costs, including but not limited to infringement compensation, attorney fees, and other reasonable costs, and guarantee that Lingbo Electronics will not suffer any losses as a result.
10.5 Any organization or individual who believes that content provided through this software may infringe on their intellectual property rights or information network dissemination rights shall promptly submit a written complaint to Lingbo Electronics, along with identification, proof of ownership, and detailed evidence of infringement. After receiving the above legal documents, Lingbo Electronics will promptly and lawfully disconnect the relevant linked content. If the complaint fails to provide Lingbo Electronics with legal and valid proof, Lingbo Electronics has the right not to take any measures.
10.6 You understand and agree that we have the right to punish users who violate relevant laws, regulations, or this agreement through reasonable judgment, take appropriate legal action against violating laws, and report relevant information to relevant authorities in accordance with laws and regulations. Users shall bear all legal responsibilities arising therefrom.
10.7 You understand and agree that any claims, demands, or losses arising from your violation of this Agreement or related service terms shall be handled and fully liable by you alone; If any losses are caused to us as a result, you shall also compensate accordingly.
You understand and agree that, like most internet software, this software may be affected by various factors, including but not limited to user reasons, network service quality, social environment, etc.; It may also be affected by various security issues, including but not limited to unauthorized use of user data by others to harass in real life; Other software downloaded or installed by users or other websites may contain viruses, trojans, or other malicious programs that threaten the security of your terminal device information and data, thereby affecting the normal use of this software. Therefore, you should strengthen your awareness of information security and personal information protection, pay attention to password protection, and avoid losses.
Lingbo Electronics attaches great importance to users' privacy rights. When users use the services provided by this software, their privacy may be involved. Please read this privacy protection policy carefully.
12.1 Please note that users must not disclose important information such as their property, accounts, bank cards, credit cards, third-party payment accounts, or corresponding passwords when using this software. Any resulting losses shall be borne by the user.
12.2 User accounts and passwords are confidential information, and Lingbo Electronics will actively strive to protect the security of user accounts and passwords.
12.3 Due to the openness of the internet and the rapid pace of technological updates, Lingbo Electronics assumes no responsibility for any user information leakage caused by factors beyond Lingbo Electronics' control.
12.4 When using the software services, users shall not publish or upload any information they believe is private, nor may such information be disseminated to others through the software services. Any privacy leakage caused by user behavior shall be borne by the user themselves.
13.1 When you use products or services provided by third parties through this software, in addition to complying with this agreement, you must also comply with the third-party user agreement. If any dispute arises between us and third parties, we shall bear corresponding responsibilities within the scope stipulated by law and the agreement.
13.2 When you use this software or request specific services, we may call third-party systems or support your use or access through third-party services. The results of such use or access are provided by third parties, and we do not guarantee the security, accuracy, effectiveness, or other uncertainties of the services and content provided by third parties. We assume no responsibility for any disputes or damages arising from the above.
14.1 The signing location of this agreement is Binhu District, Wuxi City, Jiangsu Province, People's Republic of China.
14.2 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of mainland China (excluding conflict of laws).
14.3 If any dispute or controversy arises between you and Lingbo Electronics, it shall first be resolved through friendly consultation; If negotiation fails, you agree to submit the dispute or controversy to the people's court having jurisdiction at the place where this agreement is signed.
14.4 The titles of all terms in this Agreement are for reading purposes only and do not carry any actual meaning, and cannot be used as a basis for interpreting the meaning of this Agreement.
14.5 Regardless of any reason for any partial invalidity or unenforceability of the terms of this agreement, the remaining provisions shall remain valid and binding on both parties.
14.6 The drafting and interpretation of this Agreement shall be in Chinese, and unless otherwise agreed by both parties, no translated version shall be used as a basis for interpreting this Agreement or determining the intent of both parties.
